         มาตรา ๖๐ ผู้ใดเจตนาที่จะกระทำต่อบุคคลหนึ่ง แต่ผลของการกระทำเกิดแก่อีกบุคคลหนึ่งโดยพลาดไป ให้ถือว่าผู้นั้นกระทำโดยเจตนาแก่บุคคลซึ่งได้รับผลร้ายจากการกระทำนั้น แต่ในกรณีที่กฎหมายบัญญัติให้ลงโทษหนักขึ้น เพราะฐานะของบุคคลหรือเพราะความสัมพันธ์ระหว่างผู้กระทำกับบุคคลที่ได้รับผลร้าย มิให้นำกฎหมายนั้นมาใช้บังคับเพื่อลงโทษผู้กระทำให้หนักขึ้น

Unofficial Translation

        Section 60. Any person who intends to commit an act against a person, but the effect of such act occurs to another person by accident shall be deemed to intentionally commit such act against the person who suffers from the harmful effect of such act. However, in the case where the law provides for the imposition of more severe punishment on account of individual status or the relation between the person committing the act and the person suffering from the harmful effect, such law shall not apply to impose the more severe punishment upon the person committing such act.
